Alakazam Privacy Policy 

  1. The Scope of this Policy 

Alakazam is committed to respecting your privacy rights and concerns. As such, we have  established and implemented this Privacy Policy. Alakazam uses telephone services, Zoom calls,  emails, and text messages with its customers and clients. In the process of providing data through  these channels, Alakazam implements policies and procedures to protect your privacy and the  privacy of our company. The following policy will also explain what, if any, personal information  we collect, and how we use, share, and protect such information.   1. Agreement to Terms 

All activities which you engage in through this service are voluntary. You are not required to share  any images, data, telephone numbers, emails, or other personally identifiable information with  Alakazam. In the process of communicating with Alakazam, you may be asked to provide an email,  phone number, or other data via a messaging service or text message. You are not required to  provide any personal information to us unless you choose to access features of the Service which  require such information. If you do not agree with the terms of this Privacy Policy or any other  terms or conditions of our service, then you should immediately discontinue use of the Service  without providing us any personally identifiable information. 

 

  1. Effective Date and Changes to this Notice 

This Privacy Policy is effective as of the date above and will remain in effect until a new notice  supersedes it. We may choose to update this Privacy Policy at our discretion, so you should check  this page periodically as the terms may change from time to time. The most recent version of the  notice will be reflected by the “last updated” date noted at the top of the page. In the event of a  major change to this Privacy Policy, we will provide a conspicuous message either through the  website or user portal (the “Service”) or via an email address associated with your account  informing you of the change. Your affirmative consent or continued use of the Service will  constitute your acknowledgment of the notice in its current version and your understanding of the  terms of this Policy. 

 

  1. The Information We Collect 

The types of personal information we may collect and process about you can include: 

  • Personal identifiers, including name, online identifier, email  

address, telephone number, and billing and mailing address.  

We collect such personal information directly from you via websites, email, and/or telephone  conversations when you create an account or in-person when you request certain instillation  service. Providing this information to Alakazam is completely voluntary.  

 

  1. Software and Services

Alakazam provides information technology services and database management to its customers.  For those individuals who retains our services, Alakazam will install software which permits it to  access your individual computers, servers, and databases. This permits Alakazam to analyze your Central Processing Unit (CPU), RAM information, hard drive metrics, and other important  computer and database functions. Alakazam is equipped to provide commands to its clients’  computers. These commands permit Alakazam to manage, serve, and maintain its clients’  computers, servers, and databases. If you ultimately retain our services, you will consent to  providing us unobstructed access to your computers, servers, and databases via our software. You  further acknowledge and agree that our access of your computers, servers, and databases is not a  violation of the Utah Consumer Privacy Act and is provided with authorization under Utah  Computer Crimes Act, as well as the Computer Fraud and Abuse Act. Alakazam accesses  metadata, but it does not access, store, replicate, or process the specific information, files, or data  of its users.  

 

  1. How We Protect Your Personal Information 

Your personal information, including your name, online identifier, email address, telephone  number, billing, and mailing address will only be utilized in connection with any service agreement  that you enter with Alakazam. Alakazam will not sell, disclose, transfer, or otherwise publish any  of the personal information that it collects from you. Alakazam will record and store all video,  email, and telephone communications. Recordings are taken to improve the quality of our services.  Alakazam will not sell, disclose, transfer, or otherwise publish any recorded communication. You  agree to refrain from selling, disclosing, transferring, or otherwise publishing any recorded  communication with Alakazam. You agree that your communications with Alakazam are private  and confidential. Unauthorized disclosure of any private communication with Alakazam is a  material breach of this Privacy Policy and will entitle Alakazam to immediate injunctive relief. In  the event you are in receipt of a communication, disclosure, email, call, text, or transmission from  Alakazam that was intended for a third party, you shall keep the contents completely confidential  and cooperate with Alakazam in safekeeping and returning the communication, disclosure, email,  call, text, or transmission.  

Alakazam retains obligation to respond to a subpoena or court order requiring the disclosure of  any personal information. Upon request of any court, attorney, judge, commissioner, or magistrate,  Alakazam will immediately alert you to the request for personal information and permit you  sufficient time to object to the request.  

In the event either party inadvertently discloses any personal information, communication, or  correspondence without authorization, that party shall 1) immediately alert the other party about  the unauthorized disclosure and 2) take any commercially reasonable steps to mitigate the  consequences of the disclosure.  

 

  1. Use of Website, Zoom, and Email Platforms. 

Use of the Alakazam’s website is voluntary. Alakazam retains ownership of its content, including  any intellectual property, copyright, trademark, or proprietary data. Access to Alakazam’s website  does not transfer, assign, or otherwise authorize users to utilize, copy, or encrypt the content on  the website for any purpose. You acknowledge that you will not access or use any of the content  on Alakazam’s website for any improper or illegal purpose. Your access must comply with all  local, municipal, state, and federal laws, rules, regulations, and policies.  

You will not disclose any data, information, image, or other item to Alakazam that violates any state or federal law, rule, regulation, or policy.  

 

  1. Compliance with Third Party Providers.  

You acknowledge that Alakazam utilizes third party providers for email, video-conferencing, and  other purposes. You must comply with any terms and conditions, privacy policies, rules, and  regulations of those providers. Alakazam regularly uses Zoom conferencing and Microsoft  Outlook to correspond with its clients. A violation of any terms and conditions, privacy policies,  rules, and/or regulations is a material violation of this Privacy Policy.  

 

  1. Violations. 

Any violation of this Privacy Policy is a material breach of your agreement with Alakazam.  Alakazam may immediately terminate its relationship with you. In the event of a breach, Alakazam  retains its right to cancel any service obligation to you and pursue all other available legal  remedies.  

 

  1. Your Privacy Choices 

If you no longer want to receive our emails or other announcements, you may unsubscribe by  writing to us at accounts@alakazamit.com. Please note that you cannot unsubscribe from certain  correspondence from us, including transactional messages relating directly to your account.

 

  1. How We Store and Safeguard Your Information 

We maintain reasonable technical and organizational measures to protect personal information  from loss, misuse, alteration, or unintentional destruction. Your personal information is only  accessible on a need-to-know basis and by a limited number of employees who have special  permissions.  

 

  1. Your Rights 

Upon collection, you have a right to notice of the categories of personal information collected and  for which purposes the data will be used. As noted above, we do not sell your information,  however, if you wish to exercise any of these rights or have any questions or concerns regarding  the processing of your personal information, please contact us at accounts@alakazamit.com. We  will respond to your request consistent with applicable law. 

Please note, however, before we will be able to process your request for access or deletion of  personal information, we will need to properly verify your identity for security purposes. Where  you have an account with us, you can exercise your rights while logged-in to your account.  Otherwise, if you do not have an account, but we possess appropriate information about you on 

file (e.g., name, phone number, email/physical address), we will attempt to verify your identity  using that information. If it is not reasonably possible to identify you adequately, we may not be  able to respond to your request. 

To use an authorized agent to make a request on your behalf, you will need to directly confirm  with us that you provided the authorized agent permission to submit the request, provide the  company with signed permission for the authorized agent to act on your behalf, and you will need  to verify your identity directly with the company.
